Ning-Yen Yao v. Karen Kao-Yao, 2/23/17
April 20, 2017

The trial court did not abuse its discretion in awarding defendant ten percent (10%) of plaintiff’s medical license earnings during the marriage for her noneconomic contributions. The court properly relied upon defendant’s expert in determining the value of plaintiff’s enhanced earnings, considered the statutory factors under Domestic Relations Law § 236, as well as defendant spouse’s direct and/or indirect contributions to the marriage. The court also vacated various portions of the judgment of divorce, set forth the corrections, and remanded the case to the trial court to effectuate such corrections. The lower court’s judgment was vacated, in part and the case was remanded to the trial court for further proceedings.
