The trial court erred in crediting the wife with 15 percent of the husband’s business interest. The wife’s indirect contributions to the business, as a homemaker and primary caretaker for the parties’ three children in the long-term marriage while forgoing her own career, warranted an award of 25 percent of the value of the husband’s interest in the business, Domestic Relations Law § 236(B)(5)(d)(7). The trial court providently exercised its discretion in awarding the wife 70 percent of her attorney and expert fees, Domestic Relations Law § 237(a), because of the relative financial circumstances of the parties, including the wife’s substantial distributive award, the nature and extent of the services rendered, and the relative merits of the parties’ positions at trial. The appellate court affirmed the trial court’s ruling, and, as so modified, affirmed their judgment.
