A minority shareholder’s motion to preclude the introduction of expert-witness information had to be denied because the controlling shareholders remained entitled to conduct a more detailed review of their offer in preparation for the trial. After the minority shareholder rejected the offer, any so-called voluntary disclosure regarding expert witnesses provided at the time of the offer was more than what Business Corporation Law § 623, the CPLR, and court rules required.
